SUPERMAN SKIPS STANDARD TERMS AND CONDITIONS FOR CREDIT
The following standard terms and conditions for credit apply to any agreement for the conduct of trade on credit between Superman Skips of 443 Chapel Road, Bankstown (Superman Skips) and any customer (Customer, You or Your) engaging in credit transactions with Superman Skips. This includes agreements arising from the lodgement of any Superman Skips credit application form.
Words in bold and/or capitalised words are defined terms as shown in clause 1 below.
The lodgement of a Superman Skips application for credit form by the applicant constitutes an offer by the customer to acquire and use a credit account on the terms and conditions set out in this document. Acceptance of any Skip delivery on credit terms and/or Your signature on any tax invoice issued by Superman Skips after approval of a request for credit shall constitute agreement to the supply of credit on these standard terms and conditions.
In addition to these standard terms and conditions for credit, the supply of Skip(s) is subject to the terms and conditions found on the Superman Skips application for credit form and the Superman Skips Standard Terms and Conditions.
1. Defined Terms
- Account means the credit account as approved by Superman Skips.
- Additional Fees means any additional fees charged by Superman Skips due to various reasons outlined in this section.
- Agreement includes the terms and conditions set out in the Quote and within this document.
- Collection means Superman Skips’s collection of a Skip.
- Credit Card means any credit card produced by You for payment.
- Dispute means any dispute about Skip Services including the non-supply of Skip Services.
- Fees means the fees payable to Superman Skips for provision of the Services.
- GST means any Goods and Services Tax under relevant laws.
- Insolvency Event, Law, Party, Quote, Skip, Skip Services, Waste, and Website have their respective meanings as detailed in this section.
- You means the person or entity requesting Services from Superman Skips.
2. Credit Limit
Details the maximum amount that may be charged to the Account and the conditions for reviewing and adjusting the Credit Limit.
3. Terms of Payment
Outlines the payment terms, including the due date for monthly invoices and the methods of payment.
4. Authorised & Unauthorised Transactions and Account Suspension
Details the customer’s responsibility for unauthorised use of the Account and the process for suspending the Account.
5. Proof of Supply and Transaction Errors
Specifies the evidence required for transactions and the process for disputing transaction errors.
6. Warranties Excluded
To the extent permitted by Law, all warranties not expressly included in this Agreement are excluded.
7. Your Acknowledgments
Your acknowledgments regarding entering into this Agreement.
8. Limitation on Liability
Details the limitations on Superman Skips’s liability to You or any third party.
9. Dispute Resolution
The process for resolving disputes arising under this Agreement.
10. Termination
Conditions under which Superman Skips may terminate the Agreement.
11. Privacy
Your details will be handled according to Superman Skips’s privacy policy.
12. Force Majeure
Provisions for circumstances beyond Superman Skips’s reasonable control.
13. Changes to Agreement
Superman Skips may amend these terms and conditions for credit, with such amendments applying to future services.
14. Severability
The validity of the Agreement’s provisions in various jurisdictions.
15. Waiver
Details on the waiver of rights under this Agreement.
16. Notice
Procedures for giving notice under this Agreement.
17. Governing Law
The Agreement is governed by the laws of New South Wales, Australia.
