SUPERMAN SKIPS STANDARD TERMS AND CONDITIONS
The following terms and conditions apply to any agreement between Superman Skips of 443 Chapel Road, Bankstown (Superman Skips) and any customer (Customer, You, or Your) nominated on any tax invoice, quotation, or trade contract issued by Superman Skips. Words in bold and/or capitalised words are defined terms as shown in clause 1 below. Acceptance of these terms and conditions shall be indicated by acceptance of any Quote by You; acceptance by You of any Skip delivery; and/or Your signature on any tax invoice issued by Superman Skips.
1. Defined Terms
- Account means the credit account as approved by Superman Skips.
- Additional Fees means any additional fees charged or chargeable by Superman Skips to You due to various reasons outlined in this section.
- Agreement includes the terms and conditions set out in the Quote and within this document.
- Collection means Superman Skips’s collection of a Skip.
- Credit Card means any credit card produced by You for payment.
- Dispute means any dispute about Skip Services including the non-supply of Skip Services.
- Fees means the fees payable to Superman Skips for provision of the Services.
- GST means any Goods and Services Tax under relevant laws.
- Insolvency Event, Law, Party, Quote, Skip, Skip Services, Waste, and Website have their respective meanings as detailed in this section.
- You means the person or entity requesting Services from Superman Skips.
2. Services
Superman Skips will provide the Skip and Services set out in the Quote in accordance with these terms and conditions, including delivery and removal of the skip bin to your nominated address.
3. Fees and Charges
You agree to pay the Fees and any Additional Fees as outlined, including interest on outstanding amounts and recovery costs if necessary.
4. GST
All Fees and Additional Fees are inclusive of GST. Superman Skips may recover from You any duties, taxes, or similar imposts related to the Services.
5. Cancellation or Variation
Details the conditions under which You may cancel or vary the Services, including applicable fees for late cancellations or changes.
6. Use of Skips
Outlines your responsibilities and liabilities regarding the use and treatment of the Skips, including prohibitions and requirements for proper use.
7. Rights on Non-Delivery
Specifies Superman Skips’s options in case of non-delivery of the Skip as per the agreed terms.
8. Warranties
Details the warranties provided by Superman Skips and the limitations of these warranties.
9. Indemnity
Outlines the indemnity provisions, including your agreement to indemnify Superman Skips against certain claims.
10. Your Acknowledgments
Your acknowledgments regarding the Skip and the Agreement.
11. Limitation on Liability
Details the limitations on Superman Skips’s liability to You or any third party.
12. Risk and Title
Your liability for any damage to the Skips and the retention of title by Superman Skips.
13. Dispute Resolution
The process for resolving disputes arising under this Agreement.
14. Termination
Conditions under which Superman Skips may terminate the Agreement.
15. Privacy
Your details will be handled according to Superman Skips’s privacy policy.
16. Force Majeure
Provisions for circumstances beyond Superman Skips’s reasonable control.
17. Changes to Agreement
Superman Skips may amend these terms and conditions, with such amendments applying to future services.
18. Severability
The validity of the Agreement’s provisions in various jurisdictions.
19. Waiver
Details on the waiver of rights under this Agreement.
20. Notice

21. Survival

22. Governing Law
